FindMyPhoto — Terms of Service
These terms are an agreement between you and S-Industry, based in the Netherlands ("we"), for the use of the FindMyPhoto app. By creating an account or using the app (including as a guest) you accept these terms.
1. The service
FindMyPhoto lets you find photos of yourself in shared event photo albums. You upload a selfie, submit a link to an album, and we show you the photos in which you appear. The service depends on facial recognition and on albums hosted by third parties, so we cannot promise that every photo of you will be found, or that everything found is really you.
2. Your account
You must provide accurate information and keep your login details safe; you are responsible for activity on your account. You must be at least 16 years old to use the app, or have permission from a parent or guardian. Guest use is possible; guest results are tied to your device.
3. Acceptable use
You agree to:
- upload only a selfie of yourself, never of someone else;
- submit only album links you have legitimate access to (for example, an album shared with you as an event guest);
- not use the app to identify, analyse, track or profile anyone other than yourself;
- not upload unlawful content, and not disrupt, overload, reverse-engineer or abuse the service or other people's data.
We may suspend or terminate accounts that violate these rules.
4. Your content
You keep all rights to your selfie and your photos. You grant us a limited licence to store and process them solely to provide the service (finding your photos, showing and delivering them to you, and sending you the notifications you enabled). You confirm that submitting an album link does not infringe the rights of the album owner. Note that photos in an album may be subject to the photographer's or organiser's copyright — downloading photos for personal use is your responsibility.
5. Third-party services
Albums are hosted by third parties (such as WeTransfer, PhotoCircle or Pixieset) under their own terms. Sign-in with Google or Apple, and notification delivery via Google Firebase, are subject to those providers' terms. We are not responsible for third-party services.
6. Privacy
How we handle your data — including facial recognition, storage periods and your rights — is described in our Privacy Policy, which is part of these terms.
7. Availability and changes
The app is provided "as is" and free of charge. We work hard to keep it running, but we do not guarantee uninterrupted availability, and album formats supported today may stop working if a third party changes their platform. We may change, limit or discontinue (parts of) the service; if we introduce paid features we will announce this clearly beforehand.
8. Termination
You can stop using the app and delete your account at any time in the app; your data is then removed as described in the Privacy Policy. We may suspend or end your access if you violate these terms or if we discontinue the service.
9. Liability
Nothing in these terms limits liability that cannot be limited under Dutch law, and nothing affects your statutory rights as a consumer. Otherwise, we are not liable for indirect damage (such as lost photos after the 30-day retention period, missed photos the recognition did not find, or unavailability of third-party albums). Download the photos you want to keep within the retention period.
10. Changes to these terms
We may update these terms. Significant changes will be announced in the app; the date at the top shows the latest revision. If you keep using the app after a change takes effect, you accept the updated terms.
11. Governing law
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law lets you choose the court of your place of residence.
